IntraHealth Solutions (IHS) has been working diligently to be in compliance with the HIPAA Privacy Rules and how they affect our day-to-day activities.
Under the privacy rules of the Health Insurance Portability and Accountability Act of 1996 (HIPAA) that took effect on April 14, 2003, it is required that an authorization form be completed on each participant over the age of 18. These privacy regulations protect individually identifiable protected health information (PHI) maintained by a group health plan.
The HIPAA regulations have created a great deal of confusion when it comes to issues of privacy, especially when it comes to checking claim status for family members.
The HIPAA Privacy Rules directly regulate the actions of the Covered Entities (Group Health Plans) and in-directly regulate the actions of Business Associates of Covered Entities (TPAs) with regard to Protected Health Information (PHI) that is within their care, custody, and control. The Plan Sponsor is responsible to perform the due diligence necessary to assure that their Plan and Business Associates that share PHI with their Plan are HIPAA compliant
We can provide you with drafts of our Privacy Regulations Amendment to our group health master plan documents, Privacy Statement and Business Associates Agreement. As part of our compliance efforts, we have focused on the "minimum necessary" requirement of the Regulations, as well as adopting and implementing our internal procedures to protect PHI.
Finally, we have completed the "scrubbing" of the reports available to Plan Sponsors in order to accommodate groups that only want summary health information that has been de-identified, as well as groups that wish to continue to receive detailed information.
